Some environmental law controversies arise from what are seemingly unsolvable problems at contaminated sites. On October 1, CELPC welcomes three speakers with a deep wheelhouse of knowledge regarding litigation, negotiation, and remediation of the most challenging contaminated sites. Join us for a discussion of why some controversies arising from such sites spark contentious litigation while others are resolved via negotiation, what sites suggest a long-term management approach based on their unique challenges, and some models that have been developed to address them. The panel will also share how remedies are implemented, what makes for a successful remedy, and what challenges have arisen regarding implementation.

Michael Mills is a Partner in the Environment, Land Use and Natural Resources Practice Group of Stoel Rives LLP and is the former lead of the firm’s Energy and Natural Resources Industry Group.  His practice is focused on environmental, oil and gas, mining, land use, regulatory compliance, property tax, and litigation matters.  Mike has more than twenty-five years of experience with federal and state environmental laws and regulations and has litigated environmental cases in state and federal court throughout California.  He is a past President of both the Sacramento County Bar Association and the Sacramento Chapter of the Federal Bar Association.  Mike graduated from the University of California, Davis, School of Law in 1997, Order of the Coif, and received his Bachelor of Science from U.C. Davis’s College of Agricultural & Environmental Sciences in Environmental Toxicology in 1994, summa cum laude.

Tom Bloomfield advises public and private clients on complex environmental disputes involving administrative law, public policy, and litigation.  He is adept at understanding complex technical, financial and legal issues and efficiently using that information to best represent the interests of his clients.  He routinely negotiates and drafts consent decrees, environmental cleanup documents, and other environmental settlements.  For more than 30 years, he has successfully represented his clients on major Superfund and other contamination cases, liability risk transfers, energy issues, climate, ozone and regional haze rulemakings, and oil and gas matters.  Tom has been recognized as a leading national expert on financial assurance issues, environmental insurance, fixed-price contractual arrangements, environmental remediation trusts and alternative financing approaches for public projects.  He also has deep expertise on legal issues related to emerging contaminants like PFAS, 1,4-dixoane, 123 TCP and others.  Tom is a partner at Kaplan Kirsch, LLP and prior to joining the firm, he served as an attorney at the United States Environmental Protection Agency (EPA) in San Francisco.

With nearly 40 years of environmentally-related experience, Mark Adams has successfully implemented, conducted, and managed a wide variety of large-scale environmental investigation and remedial projects for industry clients, corporate employers, the California Attorney General and the Federal Court. 

Mark has served as a Trustee for both the Lincoln Center Environmental Remediation Trust and the Jamestown Mine Remediation Trust, implementing large-scale remediation and closure plans for these sites.

In addition to Mark’s technical and regulatory expertise, a direct result of his Trustee experiences has been the development of substantial insurance, accounting and bonding knowledge and experience related to the administration of such Trusts.
