Seminar – 3 units. An examination of the doctrine, theory, and current controversies surrounding expression in schools, both K-12 and higher education. Particular attention will be given to speech at and by colleges and universities, to the difference between free speech and academic freedom, and to collisions between freedom of expression and equality, expertise, and other values that schools are arguably meant to foster.
Prerequisites: Unless excused by the instructor, prior or concurrent enrollment in Law 218 Constitutional Law II or Law 218B Con. Law II – First Amendment is required.
Final Assessment: Paper.
