Pretrial Skills

Simulation/Discussion — 2 units.  Students will sharpen lawyering skills basic to pretrial legal practice through readings, discussion, role-playing exercises, videotaped simulations, and related projects. Client interviewing, witness interviewing and depositions are emphasized; other topics include written discovery and organizing facts. The class is largely experiential, so class attendance is mandatory and preparation for, and participation in class is expected. Students will be graded on participation, several short written assignments, and performance during recorded simulations of a client interview, taking a deposition, and defending a deposition. All graded simulations and possibly some practice simulations will be conducted with partners outside of the scheduled class sessions. Students need to provide an adult volunteer from outside of the class to play the witness in one 30-minute deposition.
