Professor Hillman Comments on Lawyer Mobility for AmLaw Daily

Professor Robert Hillman commented for AmLaw Daily on issues related to a lawsuit filed in California by a former Stroock & Stroock & Lavan partner who claims he is owed retirement benefits despite jumping to another firm. 

Professor Hillman said that although restrictive covenants prohibiting lawyer movement are broadly banned around the nation, there is an exception in most states, including California, that says retirement benefits can be restricted if a lawyer jumps between firms. Hillman said that that exception is not widely known but that a growing number of firms have become interested in adding such provisions into their partnership agreements.

Robert Hillman is a Professor of Law and holds the Fair Business Practices and Investor Advocacy Chair at UC Davis School of Law.  He is a scholar in the fields of international transactions, securities regulation, and corporate and partnership law.
