Professor Larson's Article Cited in Friend-of-the-Court Brief

Professor Carlton Larson's article entitled, The Forgotten Constitutional Law of Treason and the Enemy Combatant Problem, recently formed the basis for an amicus brief in a case involving a legal challenge to the detention of an alleged enemy combatant in South Carolina.  The case is currently pending in the United States Court of Appeals for the Fourth Circuit. The brief was filed on behalf of Professor Larson and seven other professors of law and history, including professors at Harvard Law School, Stanford Law School, New York University Law School and the University of Chicago Law School.  The brief was prepared by a New Haven, CT, law firm, with the assistance of students in Yale Law School's Balancing Civil Liberties and National Security After September 11 clinic.

Professor Larson's article, published in the April 2006 issue of The University of Pennsylvania Law Review, argues that non-citizens detained within the United States are not subject to military jurisdiction .
