Professor Joslin Comments on Prop. 8 Hearings for LA Times, CPR
Professor Courtney Joslin commented on the U.S. Court of Appeals for the Ninth Circuit hearings on Proposition 8 for media including the Los Angeles Times and Capital Public Radio.
Professor Joslin participated in a "live" blog on the oral arguments hosted by the Los Angeles Times, offering in-depth comments regarding the actions of the three-judge panel deciding the appeal of Perry v. Schwarzenegger, the federal trial that overturned Prop. 8, California's same-sex marriage ban.
Professor Joslin was also cited in the Times news article on the hearings, stating that comments from Judge N. Randy Smith, a Republican appointee and the panel's most conservative member, suggested that he believes that the fact that California law provides extensive protections for lesbian and gay couples makes Proposition 8 more difficult to defend.
Speaking on Capital Public Radio's Insight program, Professor Joslin commented on several aspects of the hearings and gave her impression of what the eventual outcome may be.
"The sense I got was that all three members of the court had very serious doubts about the constitutionality of Proposition 8, but it appears that the court may be trying to issue a much more narrow ruling" than the federal court decision.
