Professor Joslin Comments on First Amendment Issue for LA Times
Professor Courtney Joslin commented on First Amendment issues associated with a California school district's ban of a clothing line bearing a logo similar to Nazi insignia. The clothing company, Metal Mulisha Compound, has threatened to sue the Murrieta Valley Unified School District, accusing the district of trademark dilution and violation of the company's right to free expression.
Professor Joslin said that the Supreme Court has ruled that a district must make a convincing case that such speech will cause disruption and disorder before banning expression.
"Fear of disruption is not enough," she said. "A school must have good, substantial and sufficient evidence. Acting upon pure fear of disorder is not enough."
