Professor Joslin Co-Authors Amicus Brief on Prop. 8

Professor Courtney Joslin co-authored an amicus brief that was filed on behalf of 28 California Family Law Professors in the litigation challenging the validity of Proposition 8, the measure which purports to amend the California Constitution to eliminate the right to marry for same-sex couples. The brief, co-authored by Michael S. Wald, Professor of Law Emeritus at Stanford Law School and submitted to the California Supreme Court on January 15 argues that, if the Court finds that Prop. 8 is valid, the Court must find that it has no effect on the marriages performed before the initiative was passed in November 2008.
