Professor Imwinkelried Comments on Cyber Security for KCBS

Professor Ed Imwinkelried discussed cyber security on KCBS radio in a news segment prompted by a recent article co-authored by Professor Imwinkelried and Michael Cherry, president of Cherry Biometrics, in the journal Judicature.  The article was touted in a UC Davis News Service press release.

KCBS interviewed Professor Imwinkelried about the article, which argues that courts should play a role in improving cyber security by expanding the scope of causation analysis in cases involving computer security breaches.  In the interview, Professor Imwinkelried pointed out that in computer security litigation, the causation issue turns on whether the plaintiff can prove that the company could have prevented the breach.  In the past, companies have relied on external add-ons such as virus scans, but those strategies have repeatedly failed.  Professor Imwinkelried and Mr. Cherry argue that computer security systems can be re-engineered to incorporate business judgment standards to determine when inappropriate quantities of sensitive information are being withdrawn and sound alerts to shut down the computer system.

Professor Imwinkelried is a world-renowned evidence expert and has published extensively in the field.
