Professor Amann Comments on 9/11 Trial for Wall Street Journal

Professor Diane Marie Amann commented for the Wall Street Journal on the upcoming trial of Khalid Sheikh Mohammed, the alleged mastermind of the September 11, 2001 terrorist attacks.  The article examines the potential impacts on the trial of statements submitted by Mohammed to a military commission last year.

Professor Amann points out that the statements, given at the Guantánamo Bay detention center, may prove to be inadmissible, since defense lawyers are likely to argue that the very fact of imprisonment at the offshore base was inherently coercive.

"You still have the situation where someone's coming into an interrogation room or some interview room at the detention center and saying, 'Can you answer these questions for litigation?'" Professor Amann said.

Diane Marie Amann is Professor of Law at the UC Davis School of Law and Director of the California International Law Center at King Hall (CILC).
