Hillman Quoted by Bloomberg
Robert Hillman, the fair business practices and investor advocacy professor of law at UC Davis, was quoted by Bloomberg in an article on U. S. Securities and Exchange Commission (SEC) Chairman Christopher Cox, who broke ranks with the agency's Republican members to recommend the continuation of a lawsuit that accuses Motorola Inc. and Cisco Systems Inc. of helping a third company inflate its revenue. The case may set a precedent for whether corporations can be sued for taking part in schemes to defraud shareholders of other companies.
"The chairman is in a particularly sensitive position,'" said Hillman, who teaches securities law at the UC Davis School of Law. "When hearings are scheduled and formal inquiries are made by Congress, the commission must be responsive to that.'"
The SEC made its recommendation to the U.S solicitor general's office, which may file a brief with the Supreme Court. The SEC is often asked to weigh in on securities lawsuits under review by the court.
