Dean Kevin R. Johnson Writes in Washington Monthly About the Disjunction Between Law and Public Resistance to Large Flows of Asylum Seekers

Aoki Center Co-Director and UC Davis School of Law Dean Kevin R. Johnson writes for Washington Monthly, "Biden’s Asylum Restrictions Run into a Roadblock."

Dean Johnson's discusses how President Biden's attempt to reduce the number of asylum seekers from south of the U.S.-Mexico border met a roadblock when in July District Court Judge Jon Tigar enjoined the restrictions. Although "the U.S. Court of Appeals for the Ninth Circuit stayed Tigar’s ruling, [and] Biden’s asylum rule remains in effect during the government’s appeal," an expedited briefing schedule with oral arguments is set for this fall and the Court's final decision is pending. 

He highlights that, "Asylum controversies recur because of the disjunction between the law and the public’s resistance to the admission of significant numbers of refugees, especially when most are people of color."

Kevin R. Johnson is the law school’s dean, Mabie-Apallas Professor of Public Interest Law and professor of Chicana/o studies at UC Davis, and Co-Director for the Aoki Center for Critical Race & Nation Studies. He is an internationally recognized scholar in the fields of immigration law and policy, refugee law, and civil rights.
