Professors Bhagwat, Brownstein Join Amicus in Trump Executive Order Case
Professor Ashutosh Bhagwat and Professor Emeritus Alan Brownstein have signed on to an amicus brief in the U.S. Court of Appeals for the Ninth Circuit case concerning the Trump administration’s appeal of a district court ruling that the order is unconstitutional.
In the brief, the amici argue that the district court properly concluded the order was not constitutional based upon “the long-settled prohibition on governmental acts based on animus toward a particular religious group.” The executive order, they state, is Trump’s attempt to fulfill a campaign promise to enact a “Muslim ban,” and thus based on an animus toward Islam.
