Professor Lin Comments on U.S. Supreme Court Term for Daily Journal

Professor Albert Lin was quoted in a Daily Journal article titled, "Environmental Issues Lose in Supreme Court."  The article examined the high court's rulings against environmental interests during the 2008-2009 term.  In one case, the court upheld the right of the Bush administration's EPA to take into account economic costs when deciding what kind of technology upgrades energy companies should make under the Clean Water Act.  Professor Lin stated that a majority on the court is "quite sensitive to concerns about costs and economics."  That concern, he added, was also reflected in a May ruling in which the Supreme Court released Shell Oil from responsibility for millions of dollars of environmental cleanup costs at a California Superfund site.
