Professor Lin Comments on Supreme Court Ruling for Daily Journal
Professor Al Lin commented for the Daily Journal on a recent Supreme Court decision that released Shell Oil from responsibility for millions of dollars of environmental cleanup costs at a California Superfund site. The decision reversed a 9th U.S. Circuit Court of Appeals ruling that held Shell liable based on its role in the delivery of chemicals to the site.
Professor Lin said the ruling reverts 9th Circuit jurisprudence on the issue "back to the way it has been in many other circuits," and amounts to "a big win for chemical manufacturers," which the government frequently pursues for cleanup costs.
