Professor Lin Comments for Media on Environmental Lawsuit

Professor Albert Lin commented for High Country News on a lawsuit filed by Portland and other west coast cities seeking to apply public nuisance laws to force Monsanto Corporation to pay for the clean-up of waterways contaminated with toxic residue from polychlorinated biphenyls (PCBs) the company produced.

A lawsuit in California applied public nuisance laws to find three companies liable for the costs of cleaning up toxic residues from lead-based paints, the article notes, and there may be an even stronger public nuisance claim in the Monsanto case, Lin said, because unlike the residences involved in the California suit, "waterways are clearly public resources."
