Professor Imwinkelried to Speak at International Evidence Seminars

Modern Law Review, one of the leading legal publications in the United Kingdom, will host a conference devoted to legal evidentiary privileges such as attorney-client. Professor Emeritus Ed Imwinkelried will speak on the first panel devoted to the theoretical rationale for recognizing evidentiary privileges.  In chapter 5 of The New Wigmore:  Evidentiary Privileges (4th ed. 2021), Imwinkelried proposed a new humanistic rationale based on decisional autonomy for evidentiary communications privileges.  In his remarks, Imwinkelried will elaborate on the philosophic case for the humanistic rationale.

In conjunction with China University of Political Science and Law (CUPL), the University of Lausanne, Switzerland, also will host an international evidence conference.  At that conference, Imwinkelried will speak on a scientific evidence topic, namely the concept of validity as applied.

In 2016, the President's Council of Advisors on Science and Technology coined that term and distinguished it from a showing of the foundational validity of a scientific methodology. Validity as applied issues arise when an expert extrapolates and attempts to apply a methodology in a situation involving specific facts exceeding the parameters of the empirical studies that the expert relies on as validation for the methodology. Imwinkelried discussed validity as applied in a 2020 Syracuse Law Review article.

Professor Imwinkelried is a world-renowned evidence expert who has published extensively in the field.
