Professor Imwinkelried to Present at Florida Justice Association Conference

On Feb. 21, Professor Emeritus Ed Imwinkelried will lecture at the annual continuing legal education conference of the Florida Justice Association in Orlando, Florida. There will be between 400 and 500 litigators in attendance. The topic of his presentation will be the admissibility of testimony about other acts of misconduct—other torts or breaches of contract—in civil actions under the Florida equivalent of Federal Rule of Evidence 404(b). 404(b) generates more published opinions than any other provision of the Federal Rules. Although in the past the courts have applied 404(b) primarily in criminal cases, the growing trend is to invoke 404(b) in civil actions as well. Professor Imwinkelried is the author of the two-volume treatise, UNCHARGED MISCONDUCT EVIDENCE 2022 EDITION (2021). Chapter 7 in Volume 2 is devoted to the application of 404(b) in civil cases.
