Professor Imwinkelried Addresses International Evidence Symposium
On Sept. 6, Professor Ed Imwinkelried spoke at the opening session of the Fourth International Symposium on Sino Swiss Evidence Science, hosted this year by the Faculty of Law of the University of Lausanne. The attendees were evidence scholars from Switzerland, China, and the United States. In his opening remarks, Professor Imwinkelried discussed the 2016 scientific evidence report of the President's Council of Advisors on Science and Technology (PCAST). He explained and endorsed a key PCAST recommendation for improving the reliability of scientific testimony, namely, requiring proof of validity as applied as well as foundational validity. He argued that pre-2016 United States Supreme Court cases had anticipated the recommendation, and he finally reviewed the American case law which has expressly imposed a requirement for a showing of validity as applied.
