Professor Imwinkelried Addresses Air Force JAG Officers

On Dec. 16, Professor Emeritus Ed Imwinkelried delivered the opening remarks at a three-day conference of Air Force Judge Advocate General officers stationed in the western United States. 

In his remarks, Imwinkelried discussed the uncharged misconduct doctrine which determines whether the prosecution may inform the jury of misdeeds other than the crime mentioned in the indictment or information. Federal Rules of Evidence 404 and 413-14 govern the doctrine, and the pertinent Military Rules of Evidence are virtually identical to the FRE provisions. FRE 404(b) generates more published opinions than any other provision of the FRE, and in many states errors in the admission of uncharged misconduct are the most common ground for reversal in criminal cases. 

In his opening remarks, Imwinkelried identified and critiqued some of the misconceptions that have arisen about the scope and proper application of the doctrine.  Imwinkelried is the author of the two-volume treatise, Uncharged Misconduct Evidence 2021 Edition (2020) and the coauthor of Military Evidentiary Foundations (7th ed. 2021). 

Professor Imwinkelried is a world-renowned evidence expert who has published extensively in the field.
