Professor Horton presents paper on probate lending at conference in Chicago

Professor David Horton presented his paper, “Borrowing in the Shadow of Death: Another Look at Probate Lending,” in June at the American College of Trust and Estate Counsel’s annual summer meeting in Chicago.

The paper examines a form of “fringe” loan (e.g., tax-refund-anticipation and payday loans) in which a lump sum is paid in return for an heir or beneficiary’s interest in a pending decedent’s case.

Professor Horton’s primary research and teaching interests are wills and trusts, contracts, and arbitration law.  In 2015, his article "In Partial Defense of Probate: Evidence from Alameda County, California" was selected as the winner of the 29th annual Association of American Law Schools (AALS) Scholarly Paper Competition and he was honored with UC Davis School of Law’s Distinguished Teaching Award.
