Professor Frank Interviewed on Property Rights Case for Daily Journal

Professor of Environmental Practice Richard Frank commented for the Daily Journal on a petition for certiorari filed with the U.S. Supreme Court in the wake of the California Supreme Court's decision to uphold a San Jose ordinance requiring developers to set aside some units for low- and moderate-income residents.  The plaintiffs in that case, the California Building Industry Association and the Pacific Legal Foundation, hope the Supreme Court will take the case and side with their contention that such requirements amount to a violation of homebuilders' property rights.

"The chances of any cert petition are numerically small, but the U.S. Supreme Court has been engaged in property rights and regulatory takings issues, and the Pacific Legal Foundation has been quite successful in engaging the Court's attention," said Frank.

Frank, a 1974 graduate of King Hall, is a leader in the field of environmental law and the founding Director of the California Environmental Law and Policy Center at UC Davis School of Law.
