Professor Frank Interviewed on Commerce Clause Case by Daily Journal

Professor of Environmental Practice Richard Frank was interviewed by the Daily Journal for an article on a lawsuit filed in federal court by Missouri and five other states over a California law that requires egg producers who sell eggs in California to comply with state laws regarding the humane treatment of laying hens.  The plaintiffs in Missouri v. Harris argue that the California law violates dormant Commerce Clause principles of the Constitution by meddling in interstate commerce.

Professor Frank said the case is part of a larger pattern in which states are using the dormant Commerce Clause to challenge leading-edge public health, environmental, and animal rights laws passed in California, such as state laws requiring cuts in the carbon intensity of vehicle fuels or banning foie gras.

Frank, a 1974 graduate of King Hall, is a leader in the field of environmental law and the founding Director of the California Environmental Law and Policy Center at UC Davis School of Law.
