Professor Frank Comments on Supreme Court Decision for NY Times

Professor Richard Frank commented for the New York Times on the U.S. Supreme Court decision in Rapanos v. United States.  The five-year-old decision has been criticized as having sown confusion for lower courts, regulators, land owners, and businesses seeking to understand wetlands regulation under the federal Clean Water Act.  The article also appeared in Greenwire.

"The short answer is that the state of post-Rapanos wetlands jurisdiction is a mess," said Frank. "Rapanos produced a broad consensus of opinion, virtually unheard of when it comes to wetlands regulation, that the Supreme Court had made things worse, rather than better."

Frank, a 1974 graduate of King Hall, recently was named as founding Director of the new California Environmental Law and Policy Center at UC Davis School of Law.
