Professor Frank Comments on Supreme Court Clean Water Act Cases for Greenwire
Professor of Environmental Practice Richard Frank commented for Greenwire on two Clean Water Act cases scheduled for argument during the upcoming term of the U.S. Supreme Court. In both cases, the Court will be reviewing decisions of the U.S. Court of Appeals for the Ninth Circuit, which has seen a number of its environmental rulings overturned or vacated by the Supreme Court.
The current Supreme Court "continues to take an interest in environmental cases," said Frank, but when it comes to the Clean Water Act, the "focus is on statutory interpretation" rather than broad constitutional issues. "The Ninth Circuit environmental jurisprudence has not fared well in the Supreme Court," he said.
Frank, a 1974 graduate of King Hall, is a leader in the field of environmental law and the founding Director of the California Environmental Law and Policy Center at UC Davis School of Law.
