Professor Frank Comments on Property Rights Case for NPR
Professor Rick Frank commented for a National Public Radio report on Sackett v. U.S. Environmental Protection Agency, a property rights case accepted last week by the U.S. Supreme Court. The case will decide whether a property owner has the right to judicial review when the EPA asserts control over private property by claiming it as "wetlands."
"Electric power plant companies, manufacturers -- a decision in this case will have a sweeping effect on both so-called mom and pop developers like the Sacketts and Fortune 500 companies," Frank said, adding that a ruling in the Sacketts' favor would likely result in less enforcement of environmental laws at the state and federal level.
Frank, a 1974 graduate of King Hall, is the founding Director of the new California Environmental Law and Policy Center at UC Davis School of Law.
