Professor Frank Comments on California Supreme Court Ruling for Al Jazeera America
Professor of Environmental Practice Richard Frank commented for Al Jazeera America on the California Supreme Court's recent ruling in California Building Industry Association v. City of San Jose, a case concerning the constitutionality of San Jose's affordable housing programs.
The program had been challenged by the Building Industry Association, which claimed that it violated property owners' constitutional rights. Last month, the California Supreme Court ruled unanimously to uphold the affordable housing program.
The ruling "removes a large legal threat from these types of measures," said Frank. It is likely to be cited as precedent in other states facing similar legal controversies, he predicted, because the "California Supreme Court is considered one of the most influential state courts in the nation."
Frank, a 1974 graduate of King Hall, is a leader in the field of environmental law and the founding Director of the California Environmental Law and Policy Center at UC Davis School of Law.
