Professor Frank and Janelle Krattiger '14 File Brief on Delta Litigation
On April 13, Professor of Environmental Practice Richard Frank '74 and Environmental Law Fellow Janelle Krattiger '14 filed a friend-of-the court brief in currently pending litigation over the future of California's embattled Sacramento-San Joaquin Delta. Frank and Krattiger filed the brief on behalf of former California State Senator (and current member of the Santa Clara Board of Supervisor) Joe Simitian.
In 2009, Senator Simitian was the lead author of SB 7X 1, popularly known as the Delta Reform Act, legislation that devised a new governance structure for the Delta led by a new state agency, the Delta Stewardship Council. The brief filed by Frank and Krattiger on behalf of former Senator Simitian urges the Sacramento County Superior Court to uphold the 2014 Delta Plan adopted by the Council against legal challenges brought against the plan by various Delta stakeholders. That brief argues that the Council's Delta Plan fully meets all procedural and substantive requirements of the Delta Reform Act and that the legal challenges to the Plan should therefore be rejected by the court.
