Professor Dodge Cited in District Court Opinion
In Thornton Tomasetti, Inc. v. Anguillan Development Corp., U.S. District Judge J. Paul Oetken decided to stay a breach of contract action in deference to a parallel foreign proceeding, citing a forthcoming article by Professor William S. Dodge.
The article, "International Comity in American Law," will appear in the Columbia Law Review. It describes and categorizes the range of international comity doctrines in American law, including the doctrines of adjudicative comity under which U.S. courts sometimes stay or dismiss cases in deference to foreign courts.
Professor Dodge is an influential international law scholar. He serves as a Co-Reporter for the American Law Institute's Restatement (Fourth) of Foreign Relations Law: Jurisdiction and as a member of the State Department's Advisory Committee on International Law. He is a co-author of the casebook Transnational Business Problems and a co-editor of International Law in the U.S. Supreme Court: Continuity and Change, which won the American Society of International Law's 2012 certificate of merit. He has authored more than 40 other publications in books and law reviews.
