Professor Chin Interviewed on Supreme Court Immigration Case by Courthouse News Service
Professor Gabriel "Jack" Chin was interviewed regarding the U.S. Supreme Court case U.S. v. Texas by the Courthouse News Service. The outcome of the case, which concerns the Obama administration's Deferred Action for Parents of Americans (DAPA) executive action, is unlikely to be impacted by the recent death of Justice Antonin Scalia, he said.
"The effect will be small to none, because his vote, almost certainly, would not have been decisive," Chin said, noting that Scalia was unlikely to have joined a 5-4 majority to overturn the district court injunction currently blocking the order.
Chin is one of 109 immigration law professors who signed onto an amicus brief stating they believe DAPA is "well within the secretary of the Department of Homeland Security's express statutory authority to establish national immigration enforcement policies and priorities."
