Professor Amar Comments on Direction of Supreme Court in ABA Journal
In the ABA Journal's July 2008 Supreme Court Report, "About Face," Professor Vikram Amar discussed the direction of the Supreme Court. Amar noted that with the rapid shift in acceptance of as-applied challenges versus facial challenges, the Court's future direction is uncertain. Since the recent appointments of Justice Samuel Alito and Chief Justice John Roberts, the Court has sent the message that generalized challenges to new laws will be unsuccessful; lawyers must be more specific and present concrete evidence that a law will in fact deprive particular persons of their constitutional rights.
