Professor Imwinkelried joins research center at Northumbria University
Professor Ed Imwinkelried has been selected as an external member of the Centre for Evidence & Criminal Justice Studies. The center is headquartered at Northumbria University in the United Kingdom.
Together with two Northumbria faculty members, Centre Director and Professor Rebecca Mitchell and Professor Michael Stockdale, Imwinkelried recently prepared a comparative study of the use of deferred prosecution agreements (DPAs) in the United States and the United Kingdom and their impact on legal evidentiary privileges in those jurisdictions.
In order to enter into a DPA, a corporate target sometimes agrees to waive its legal privileges. Questions have arisen as to when it is appropriate for the prosecution to demand or accept such a waiver and whether there should be judicial oversight of the approval of DPAs. The study soon will appear in a special issue of the Journal of International and Comparative Law.
