Lin Quoted in Daily Journal in Environmental Suit
Albert Lin, a professor of law wand specialist in environmental law, commented for the Daily Journal on Governor Schwarzenegger's decision to file suit in Washington, D.C., instead of California, against the Environmental Protection Agency over auto emissions. The suit accuses the Bush administration of failing to grant California a waiver to enforce tougher regulations on emission standards for automobiles sold in the state.
There had been speculation that the lawsuit would be filed in a California court, ensuring that any review goes to a more familiar and potentially friendlier 9th U.S. Circuit Court of Appeals.
"Because the D.C. Circuit is a specialist in administrative law, you might imagine a decision coming out of the D.C. Circuit getting more respect by the Supreme Court," said Lin.
