Extraterritorial Regulation of Business: From Securities to Bankruptcy and Beyond Lecture

Please join Professor Dodge as he delivers a lecture to mark his appointment as the John D. Ayer Chair in Business Law.

Since 2010, the U.S. Supreme Court has been applying a new presumption against extraterritoriality to determine the geographic scope of federal statutory provisions. Professor Dodge will discuss the Court's application of this new presumption to federal securities law in Morrison v. National Australia Bank and the lower court cases following Morrison. 

The new presumption has also been applied to provisions of the Bankruptcy Code. Professor Dodge will discuss a recent Second Circuit decision applying the presumption in the Madoff bankruptcy case in which a petition for certiorari is currently pending.
