Is Conspiracy a War Crime?

Professor Diane Marie Amann commented for the Christian Science Monitor on the decision of Supreme Court Justice Anthony Kennedy to withhold a vote that would help determine whether or not conspiracy constitutes a war crime. In Hamden v. Rumsfeld, Kennedy provided the decisive fifth vote striking down Guantanamo commission procedures, but he declined to provide a fifth vote on the jurisdictional question involving conspiracy. The White House is now urging Congress to pass a law recognizing conspiracy as a war crime.
