Chief Justice Roberts Cites Professor Elmendorf in Dissent

U.S. Supreme Court Chief Justice John Roberts cited Professor Christopher Elmendorf in his dissent in Merrill v. Milligan.

On Feb. 7, the court voted 5-4 to allow Alabama to go forward with a redistricting plan that had been challenged as racial gerrymandering. In his dissent, Roberts cited Elmendorf’s 2011 University of Pennsylvania Law Review article “Making Sense of Section 2: Of Biased Votes, Unconstitutional Elections, and Common Law Statutes.”

Elmendorf is a professor of law at UC Davis School of Law whose teaching and research interests include election law, administrative law, statutory interpretation, constitutional law, and property and natural resources law.
