Associate Dean Amar Comments on Apple Suit for Bloomberg Businessweek
Vikram Amar, Associate Dean and Professor of Law at UC Davis School of Law, commented for Bloomberg Businessweek on a $1 billion class action suit against Apple Inc. involving allegations that the company sought to prevent consumers from loading music from rival music stores onto its iPod players.
Although evidence has emerged that the named plaintiff in the suit did not purchase an iPod during the period covered by the case, the trial could still move forward with a new plaintiff, Amar said. The new plaintiff would have to be an individual who was injured by the conduct being challenged in the lawsuit, and the procedure for choosing this person would have to be approved by U.S. District Judge Yvonne Gonzalez Rogers, who is hearing the case, Amar said.
