Assoc. Dean Amar Comments on Ninth Circuit Affirmative Action Case for San Jose Mercury News
Vikram Amar, Associate Dean and Professor of Law at UC Davis School of Law, commented for the San Jose Mercury News on the pending U.S. Court of Appeals for the Ninth Circuit arguments on California's Proposition 209, which outlawed affirmative action programs in the state's public agencies. The Ninth Circuit upheld Prop. 209 in 1997, but opponents are hoping new data on student admissions and a 2003 Supreme Court ruling allowing law schools to consider race in admissions has opened the door to striking down affirmative action bans. Professor Amar said it was doubtful that the Ninth Circuit would overturn its own precedent. "I don't think this three-judge panel can disregard what those judges did back in '97," he said.
