SCOTUS Orders Reinstatement of the "Remain in Mexico" Policy

On August 24, 2021, the U.S. Supreme Court issued an order denying the Biden administration's application to stay the Migrant Protection Protocols program, also known as "remain in Mexico" policy. The policy requires asylum seekers to stay in Mexico while they wait for a hearing in the U.S. immigration court. The court order explained that the Biden administration failed to show that its attempt to end the policy was not "arbitrary and capricious". Justices Breyer, Sotomayor, and Kagan dissented.
