Biden Administration Executive Order seeks to Promote Competition by Limiting Non-Compete Agreements
On July 9, 2021 President Biden signed the Executive Order on Promoting Competition in the American Economy. The Order directs the Federal Trade Commission (FTC) to consider enacting rules to ban or limit non-compete agreements. The scope is unclear as the Order calls for the FTC to curtail "unfair use" of non-compete clauses. The Order also addresses other clauses that may restrict employee movement such as employee and customer non-solicitation agreements. See National Law Review, JDSupra.
