9th Circuit Upholds California Ban on Large-Capacity Gun Magazines

In a Nov. 30, 7-4 en banc opinion, the Ninth Circuit Court of Appeals upheld California's ban on high-capacity gun magazines holding more than 10 rounds of ammunition. The ruling upholds Proposition 63, approved by voters in 2016, and SB 1446, also enacted in 2016; both laws sought to respond to mass shootings. In the decision, Judge Susan P. Graber wrote that the ban "interferes only minimally" with Second Amendment rights, and that it did not effect a taking or violate due process rights.
