This course will examine the process of selecting Presidents of the United States within the structure created by Article II and other provisions of the U.S. Constitution, as well as federal and state enactments. Among the topics to be considered are: the creation of the electoral college and modern reform possibilities; so-called "faithless" electors; the Bush v. Gore dispute; the so-called "Independent State Legislature" theory; presidential succession; vice-presidential selection; Section 3 of the Fourteenth Amendment, and various presidential immunities that might bear on ability to serve. The course will examine, among other things, Supreme Court caselaw, academic commentary and state-law reform efforts.
Prerequisite: Law 205 Constitutional Law I is required.
Law 218 Constitutional Law II is recommended.
