Iowa Supreme Court Dissent Cites Professor Joh

Iowa Supreme Court Justice Matthew McDermott cited Professor Elizabeth Joh in his dissent in Iowa v. Jerry Lynn Burns. The court affirmed the 2018 conviction of Burns in the 39-year-old cold case murder of Michelle Martinko, denying Burns’ argument that police violated his constitutional rights in obtaining a DNA sample from a soda straw.

McDermott cited Joh’s 2006 Northwestern Law Review essay “Reclaiming ‘Abandoned’ DNA.”

Professor Joh's scholarship focuses on criminal law and procedure, with a special emphasis on the police use of new technologies. She is the recipient of King Hall’s 2017 Distinguished Teaching Award.
