Third Circuit opinion in Second Amendment case cites Professor Larson

The United States Court of Appeals for the Third Circuit Senior Judge Jane Richards Roth cited Carlton F.W. Larson in her opinion in Beers v. United States, a case that challenged a federal law prohibiting ownership of firearms by anyone who has been adjudicated as mentally ill or committed to an institution.

Roth cited Larson’s 2009 article “Four Exceptions in Search of a Theory: District of Columbia v. Heller and Judicial Ipse Dixit,”which provides historical context for the treatment of the mentally ill in regard to gun ownership.

Carlton Larson's research interests focus on constitutional law and legal history, with a strong emphasis on the 18th century. One of the nation’s leading authorities on the law of treason, he is the author of The Trials of Allegiance: Treason, Juries, and the American Revolution (Oxford University Press), which will be released on Sept. 27, 2019.
