Dean Johnson Comments on Wells Fargo Suit for Northern California Record
Dean Kevin R. Johnson commented for the Northern California Record on a lawsuit alleging that Wells Fargo denied the loan application of an undocumented immigrant who was granted Deferred Action for Childhood Arrivals (DACA) status after the applicant disclosed she was not a U.S. citizen.
In allowing the case to move forward, Northern District of California Judge Maxine M. Chesney “found that the civil rights statutes applied as well as the federal statute generally regulated lending,” Dean Johnson said. Dean Johnson said DACA recipients are entitled to live and work in the United States, and he could not see any legal basis for denying them loans so long as they are otherwise eligible.
Kevin R. Johnson is Dean and Mabie-Apallas Professor of Public Interest Law and Chicana/o studies at UC Davis School of Law. He is an internationally recognized scholar in the fields of immigration law and policy, refugee law, and civil rights.
