Dean Johnson Comments on Supreme Court Immigration Ruling for Law 360

Dean Kevin R. Johnson commented for Law360 on the U.S. Supreme Court’s decision in Sessions v. Morales-Santana, which struck down a gender-based difference in immigration law and dealt a blow to the plenary power doctrine, which holds that courts should defer to the executive and legislative branches on immigration.

Dean Johnson said the plenary power doctrine may be on its way to becoming a “historical artifact.”

“In some ways, I think this case is actually important as a step toward making immigration law … more mainstream in terms of our constitutional jurisprudence,” Johnson said.

Kevin R. Johnson is Dean and Mabie-Apallas Professor of Public Interest Law and Chicana/o studies at UC Davis School of Law. He is an internationally recognized scholar in the fields of immigration law and policy, refugee law, and civil rights.
