Professor Bhagwat Comments on Supreme Court Nominee for Buzzfeed

Professor Ashutosh Bhagwat commented for Buzzfeed on how Supreme Court nominee Judge Neil Gorsuch might impact the amount of deference the Court has given to regulatory agencies. 

Professor Bhagwat said that, should he be confirmed, Gorusch would be unlikely to find majority support for a challenge to the legal doctrine known as Chevron.  Named for a 1984 Supreme Court decision, Chevron holds that courts should defer to regulatory agencies’ interpretation of a law unless it’s unreasonable.  Gorusch, a critic of the doctrine, would be unlikely to find enough support among his colleagues to overturn it, but it’s likely he would be a reliable vote to at least weaken it, Bhagwat said.
