Professor Larson Comments on State’s Rights for All Things Considered
Professor Carlton Larson is quoted in an episode of the National Public Radio program All Things Considered that explores the potential for Democrats in California to employ a “state’s rights” argument in opposing the agenda of Republicans in control of the federal government. Both parties tend to use that argument when the other is in power in Washington, but Democrats may want to be careful about pushing state’s rights too far, Larson said.
“If we were to push back very, very heavily against federal law, there's a real danger for that because it would affect not just the particular law you're challenging - it may be something you don't like out of the Trump administration - but all kinds of other laws as well,” said Larson.
Carlton Larson's research interests focus on constitutional law and legal history, with a strong emphasis on the 18th century.
