Professor Joslin Comments on Child Support Case for Associated Press

Professor Courtney Joslin commented on a Kansas judge’s decision to deny a state Department for Children and Families request that a sperm donor be declared the child’s legal father and be held responsible for child support in an Associated Press article published numerous print and online media outlets.

Kansas law says that a man who provides sperm to a doctor is not the child’s legal parent, absent a written agreement to the contrary, but in this case no physician was involved. Joslin said a commission on uniform state laws recommended in 2000 and 2002 that states eliminate the requirement for a physician’s involvement, and California independently repealed the requirement as of this year.
