Holly S. Cooper Comments on Supreme Court Immigration Case for NBC, Law360

Holly S. Cooper ’98, Co-director of the UC Davis School of Law Immigration Law Clinic, commented for NBC News online and for Law360 on the U.S. Supreme Court case that will decide whether immigrants held in mandatory detention must be given bond hearings if their detention lasts for half a year. With immigration enforcement expected to be more aggressive under the administration of president-elect Donald Trump, the case takes on added importance, Cooper said.

"Because detention is going to increase ... we need to have more robust procedural protections for individuals who will be detained,” Cooper told Law360. “And this case, if decided favorably, would provide that."

If the Supreme Court sides with lower courts and finds that immigrants should be able to challenge detention, it would make it more difficult for Trump to deport undocumented immigrants at the rate he has proposed, Cooper told NBC.

"If Trump wants to implement his plan, he would have to create enormous infrastructure to do so," Cooper said.
